2. These terms
These terms apply to every order you place on mellodeluxe.com. Please read them before you order. By placing an order, you agree to them. We may update these terms from time to time; the version on the website when you order is the one that applies.
We sell to consumers in the United Kingdom only. For wholesale orders, please use the wholesale enquiry form.
3. Our products
Mello Squeezeable Marshmallow Crème is sold in 175g tubes. Product photos are for illustration; the packaging you receive may vary slightly.
Ingredients, allergens, storage instructions and nutritional information are shown on the website and on the pack. Please always read the label before eating, especially if you have an allergy. If you have any questions about allergens, email us before you order.
4. Prices and payment
Prices are in pounds sterling (£). We are not VAT registered, so no VAT is added to our prices. Delivery charges are shown before you pay.
We take payment by card, Apple Pay and Google Pay through Stripe. We never see or store your full card details. Payment is taken when you place your order.
If we make an obvious pricing mistake, we will contact you before dispatch, and you can either pay the correct price or cancel for a full refund.
5. Your order
After you order, you will receive an email confirming that we have received it. Our contract with you starts when we send you an email confirming dispatch.
We may refuse or cancel an order, for example if a product is out of stock or there is a problem with payment. If we do, we will tell you and refund you in full.
6. Offers
From time to time we run offers, such as a free limited edition Mello gift bag with orders of two or more tubes. Offers last while stocks last, apply only to orders placed on mellodeluxe.com, cannot be exchanged for cash and may end at any time. If you return items from an order that included a free gift, please return the gift too.
7. Delivery
We deliver to addresses in the United Kingdom only, by Royal Mail. We aim to dispatch orders within [X] working days. Delivery times after dispatch depend on Royal Mail and are estimates.
If your order has not arrived within 10 working days of dispatch, please email us and we will help. Responsibility for the goods passes to you when they are delivered to the address you gave us.
8. Damaged or faulty items
If anything arrives damaged, leaking or faulty, or is not what you ordered, email [email protected] within 7 days of delivery with your order number and a photo. We will send a replacement or give you a full refund, including delivery.
This does not affect your legal rights under the Consumer Rights Act 2015.
9. Cancelling your order
You can cancel your order within 14 days of the day you receive it, for any reason, as long as the tubes are unopened and the seal is unbroken. For hygiene and safety reasons, we cannot accept opened tubes unless they are faulty.
To cancel, email [email protected] with your order number. Please send the unopened items back within 14 days of telling us. You pay the cost of returning them, unless they are faulty or we sent the wrong item.
We will refund the price of the items and the standard delivery charge within 14 days of receiving them back, to the payment method you used.
10. Our liability
We are responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care. We are not responsible for loss or damage that is not foreseeable, or for business losses.
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.
11. Events outside our control
We are not responsible for delays caused by events outside our reasonable control, such as postal strikes or severe weather. If this happens, we will tell you, and you can cancel for a full refund if the delay is long.
12. Your personal data
We use your personal data as set out in our Privacy Policy.
13. Complaints and law
If you have a complaint, email [email protected] and we will reply as soon as we can, usually within 5 working days.
These terms are governed by the law of England and Wales. You can bring legal proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts.
